Welcome to countrygoodsusa.com (the “Site”), operated by Heather Lemere dba Lemere Electric  (“Lemere Electric,” “we,” “us,” or “our”). By accessing or using the Site, placing an order, joining our rewards or referral programs, or opting into email/SMS, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site.

1) Eligibility & Accounts

Age. You must be at least 18 to make a purchase and 13+ to use the Site with a parent/guardian’s consent.

Account Security. You are responsible for maintaining the confidentiality of your login and for all activities under your account. Notify us immediately of any unauthorized use.

Accuracy. Provide current, complete, and accurate information. We may refuse or cancel orders if information appears inaccurate, fraudulent, or in violation of these Terms.

2) Orders, Pricing & Payments

Offer & Acceptance. Your order is an offer to buy; we accept when we ship or otherwise confirm acceptance.

Pricing & Availability. We may change prices, promotions, and availability at any time. Despite our efforts, errors may occur; we may cancel or correct any order affected by an error (including after submission) and will refund any amount charged.

Taxes & Shipping. Prices exclude applicable taxes and shipping unless stated. You are responsible for taxes, duties, and fees.

Payment Processing. Payments are handled by third‑party processors (e.g., Stripe, PayPal). We do not store full card numbers.

Risk of Loss & Title. Title and risk of loss pass to you upon our delivery to the carrier. Please inspect packages on delivery.

3) User Content (Reviews, Photos, Social Tags)

When you submit content (e.g., reviews, photos, social media tags #countrygoodsusa):

You grant us a worldwide, royalty‑free, perpetual license to use, reproduce, modify, display, and distribute that content in any media for marketing or other purposes.

You represent you own or have rights to the content and that it does not infringe, defame, or violate any law or third‑party right.

We may moderate or remove content at our discretion.

Our products are handcrafted with simple, high‑quality ingredients. However, everyone’s skin is different. Perform a patch test first and discontinue use if irritation occurs.

Our products and statements are not intended to diagnose, treat, cure, or prevent any disease and have not been evaluated by the FDA.

Review ingredient lists for potential allergens; contact us with questions before purchase.

6) Third‑Party Links & Tools

The Site may link to third‑party sites or tools we do not control. We are not responsible for their content or practices. Use at your own risk and review their terms and policies.

Opt‑Out. Reply STOP to cancel; HELP for help. You may still receive critical transactional texts as permitted by law (e.g., delivery notices).

8) DMCA / Copyright Policy

If you believe content on the Site infringes your copyright, send a notice with: (1) your contact info, (2) identification of the work claimed infringed, (3) identification of the material to be removed, (4) a good‑faith statement, and (5) a statement under penalty of perjury that you are authorized to act, to:service@lemereelectric.com. We may remove content and terminate repeat infringers.

9) Warranties & Disclaimers

The Site and all products/services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, or non‑infringement. To the fullest extent permitted by law, we do not guarantee uninterrupted, error‑free, or secure operation of the Site.

10) Limitation of Liability

To the maximum extent permitted by law, Lemere Electric and its owners, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Site or purchase/use of products, even if advised of the possibility. Our aggregate liability for any claim shall not exceed the amount you paid for the product or service at issue in the 12 months preceding the claim.

11) Indemnification

You agree to defend, indemnify, and hold harmless Lemere Electric and our owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your breach of these Terms, or your violation of any law or third‑party right.

12) Dispute Resolution; Arbitration; Class Action Waiver (U.S.)

PLEASE READ THIS SECTION CAREFULLY—IT AFFECTS YOUR RIGHTS.

Informal Resolution. Contact us first to attempt to resolve any dispute.

Binding Arbitration. Except for small‑claims matters or claims for injunctive relief, any dispute between you and us relating to these Terms or the Site/products will be resolved by binding arbitration under the AAA Consumer Arbitration Rules. Arbitration will be conducted by a single arbitrator, and may be held by phone/video or on written submissions.

Class Action Waiver. You and Lemere Electric agree that each may bring claims only in your/its individual capacity, and not as a plaintiff or class member in any putative class or representative proceeding. The arbitrator may not consolidate claims of more than one person.

Opt‑Out. You may opt out of arbitration/class waiver by sending written notice to service@lemereelectric.com within 30 days of your first use of the Site after the date these Terms took effect for you.

Governing Law & Venue. These Terms are governed by the laws of the State of Idaho, without regard to conflict of laws. For claims not subject to arbitration (e.g., small claims), the exclusive venue shall be the state or federal courts located in Canyon County, Idaho.

19) Termination

We may suspend or terminate access to the Site or any account at any time for any reason, including if we believe you violated these Terms or applicable law. You may cancel your account at any time.

20) Changes to the Site or Terms

We may update the Site and these Terms from time to time. The “Last updated” date reflects the latest revision. Continued use after changes means you accept the updated Terms.
